Terms of Use

These Terms are a legal agreement between you and [LEGAL ENTITY NAME], [REGISTERED ADDRESS], India ("KiT-PaT", "we", "us"), governing your use of the KiT-PaT website and apps (the "Service"). By using the Service you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

1. What KiT-PaT is

KiT-PaT is a tool that helps a group of people run their monthly kitty party. It lets members record contributions, mark payments, plan gatherings, play games together, and store photos, and it keeps the group's totals.

KiT-PaT is not a bank, NBFC, chit fund or money-management service, and it does not hold, pool, collect or lend your group's money. The kitty is contributed and settled between the members; the app keeps the record. The only money KiT-PaT charges is a subscription fee for the app, which is processed by a third-party payment gateway. KiT-PaT is not a party to the money that members contribute to their kitty.

2. Who can use it

You must be 18 or older and able to enter a binding contract under Indian law. By using the Service you confirm that you are.

3. Your account

Keep your login and one-time passwords private, and your details accurate. You are responsible for activity under your account. Tell us promptly at support@kitpat.in if you suspect unauthorised use.

4. Your responsibilities and acceptable use

You agree to:

  • record entries and payments honestly and keep your group's data accurate;
  • treat other members with respect;
  • use the Service only for lawful purposes.

You agree not to:

  • upload content that is unlawful, defamatory, obscene, hateful, infringing, or that you don't have the right to share;
  • impersonate anyone, harvest others' data, or invade anyone's privacy;
  • attempt to break, overload, reverse-engineer or gain unauthorised access to the Service; or
  • use the Service to defraud or harm other members.

We may remove content or suspend accounts that break these rules, and — as an intermediary under the IT Rules, 2021 — we act on valid legal or grievance requests.

5. Your content

You keep ownership of the photos and content you add. You grant KiT-PaT a limited, non-exclusive licence to store, display and process that content within your group and as needed to provide the Service. You are responsible for having the right to share what you upload, including photos of other people.

6. The group's data and records

KiT-PaT's value is the group's accumulated record. Members can view and, in defined ways, add to the shared ledger; administrators can correct wrong entries with a reason and an audit trail. Money disputes between members are for the members to resolve; KiT-PaT provides the record, not adjudication.

7. Paid features

The Service is free to begin. If we offer paid plans, the price and what it includes will be shown before you pay, and the Refund & Cancellation Policy will apply.

8. Availability and changes

We work to keep the Service running, but we may add, change, suspend or withdraw features, and the Service is provided "as is" and "as available" without warranties of uninterrupted or error-free operation to the extent the law allows.

9. Limitation of liability

To the maximum extent permitted by law, KiT-PaT is not liable for indirect, incidental or consequential losses, for loss of data or profits, or for disputes about money between members. Nothing in these Terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2019.

10. Indemnity

You agree to indemnify KiT-PaT against claims arising from your misuse of the Service or your breach of these Terms or of another person's rights.

11. Suspension and termination

You may stop using the Service and delete your account at any time (see Privacy Policy section 9). We may suspend or end access if you break these Terms or where we must for legal or security reasons.

12. Grievances

For any complaint about the Service or content, contact our Grievance Officer, [GRIEVANCE OFFICER NAME], at support@kitpat.in. We acknowledge within 48 hours and aim to resolve within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020 and the IT Rules, 2021.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any right you have under consumer law to approach a consumer forum, the courts at [CITY], India have jurisdiction.

14. Changes to these Terms

We may update these Terms and will post the new version here with a new date. Continuing to use the Service means you accept the change.
